Disappointingly, the LECs are taking a negative approach.  I posted preliminary comments on their comments here. 2006-04-27T18:31:21-08:00 Powell Warns Net Neutrologists Not to Be Naive (Howard C. Berkowitz) http://www.voiponder.com/posts/powell_warns_net_neutrologists/#1840 http://www.voiponder.com/posts/powell_warns_net_neutrologists/#1840 To follow up on the preceding post, I am aware of the safe harbor provisions of the Communications Decency Act, Section 230(c) if my memory is correct.  Nevertheless, I beleive that safe harbor applies to those who do not look at content. Non-neutral carriers, even if they only look at IP addresses, protocol numbers, TCP/UDP port numbers, and probably traffic statisics do look at attributes of content and make content-related decisions for reasons of business policy. 2006-04-27T00:12:02-08:00 Today's Carrier Networks as Trollways? (George Muenz) http://www.voiponder.com/posts/todays_carrier_networks_as_trollways/#1839 http://www.voiponder.com/posts/todays_carrier_networks_as_trollways/#1839 Excellent article, and oh so true. In fact, Telcos today are seeking to increase usage fees for those who use more bandwidth, despite the fact that Telcos pay less the more bandwidth they use or nothing at all under Peering arrangements. Berkowitz) http://www.voiponder.com/posts/powell_warns_net_neutrologists/#1838 http://www.voiponder.com/posts/powell_warns_net_neutrologists/#1838 I’ve wondered if there is a forgotten legal danger to the telcos and cable providers in going against net neutrality. In the past, whenever there is an attempt to make them parties to civil (and sometimes criminal) litigation over threatening, obscene, or otherwise objectionable content transmitted over their wires, they piously claim “we are but carriers and have no control over content”. In this Brave New World, however, how can they claim not to have awareness of content when they price differentially on it, or even block access based on content?  At that point, do their deep pockets become inviting to the doctrine of joint and several liability? 2006-04-24T07:33:45-08:00 Secure Voice over IP: Zfone Released (Howard C. Berkowitz) http://www.voiponder.com/posts/secure_voice_over_ip_zfone_released/#1837 http://www.voiponder.com/posts/secure_voice_over_ip_zfone_released/#1837 Ah yes. It will be interesting to see what happens when strongly encrypted voice hits wide-open interception. Back to traffic analysis, I suppose. 2006-03-16T22:00:04-08:00
